Q: If a non-agent finds a buyer do I still have to pay full commission to my agent or does that non-agent get the agreed 3% as if they were the seller?s agent?

A: Usaually to receive commissions you need to be a licensed Realtor. Check with your state?s laws regarding this issue. In this situation your agent the seller?s agent would recive the total commission. Possibly you could ask her to minimize her take since there isn?t a buyer?s agent, unless she did bring the buyer in.

You have signed a listing agreement with your broker and in that agreement, it spells out the commissions you will be paying. On a different and separate agreement, the listing broker makes an ?offer of cooperation? through the MLS system. Two completely different agreements. You are bound by yours and your brokers. A person who is not licensed in your state to sell real estate (non-agent) cannot receive any commissions.
